When do I have to have compliance language?

To comply with regulations by the Federal Communications Commission, text message marketers must obtain “prior express written consent” before texting customers.

For subscribers who opt-in from a web-form, you’ll have to include compliance language on your opt-in widget, your landing page or sweepstakes, or on any flyers and you’ll also have to confirm opt-in via text with Y/Yes, zip-code, or another response. If they opt-in by texting your keyword to your phone number, you’ll need to include compliance language in your text back, but you don’t have to confirm opt-in.
