When do I have to have compliance language?

To comply with Federal Communications Commission (FCC) regulations, text message marketers must obtain “prior express written consent” before sending marketing texts to customers.

When to Include Compliance Language

1. During Opt-In

  • Web Form Sign-Ups – Include compliance language on:

    • Your opt-in widget

    • Landing pages or sweepstakes entries

    • Any printed materials (e.g., flyers) promoting sign-up

    • Plus: Confirm opt-in via text (e.g., “Y/YES,” zip code, or similar response)

  • Keyword Opt-Ins – If a subscriber texts your keyword to your phone number, include compliance language in your reply text. Confirmation is not required in this case.

2. After Opt-In

  • Once a subscriber joins your text club, FCC rules require you to send compliance language at least once a month to stay compliant.
